A notable emerging trend across states includes the regulation of emissions from "indirect sources" like airports, large entertainment venues, and warehouses. By November, the Colorado Regional Air Quality Council will propose the state's first rules aimed at limiting emissions generated by the vehicle traffic these facilities attract, as mandated by a 2022 law. While similar rules exist regionally in California, Colorado's proposal represents a novel statewide approach to penalizing warehouses for associated transportation emissions. The Colorado initiative mirrors proposals at the federal level and in other states like New York and New Jersey, where lawmakers are increasingly exploring indirect source rules to address air pollution from logistics hubs, often requiring warehouse operators to mitigate or offset emissions from the trucks servicing their sites.
