State legislatures have actively pursued legislation to prevent heat illness and injury in the workplace over the last several years. Five states (California, Colorado, Oregon, Washington, and Minnesota) already have some form of permanent occupational heat stress standards. In previous newsletters, we discussed bills in New York, New Jersey, and Illinois. That trend continues to grow, and today, we will discuss two new bills in Texas and Rhode Island.
The Biden Administration had issued a proposed rule to prevent heat illness and injury in indoor and outdoor workplace settings; it is unclear what will happen to the rule under the Trump Administration. NAW submitted comments urging the agency to withdraw the proposal as it exceeds the agency's legal authority, is overly broad, and threatens to undermine the operational needs of NAW members. With the uncertainty of what the Trump Administration will do, we expect to see more states active in this space this year.
