As reported in mid-January, the U.S. Supreme Court decided that it would consider the sales tax collection fairness issue when it granted a Writ of Certiorari in South Dakota v. Wayfair.   NAW submitted an amicus curiae brief during the cert stage, and has now joined as one of 22 parties to an amicus brief in the merits stage.  Click here to read a copy of the latest brief.

The process that lies ahead in this litigation is as follows:

  • Respondents’ brief is due on March 28th
  • South Dakotas’ reply brief is due on April 10th
  • Oral argument is scheduled for April 17th
  • Decision by end of 2017-2018 term (end of June)
